Terms of Service

These Terms of Service ("Terms") are an agreement between you and PhotoBooth Today ("we," "us") governing your use of the PhotoBooth Today website and application (the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
1. The Service
PhotoBooth Today is software that photo-booth businesses use to manage bookings, inquiries, quotes, invoices, contracts, photo galleries, staff, and related communications. We may add, change, or remove features over time.
2. Your account
- You must be at least 18 and able to form a binding contract, and use the Service for a legitimate business.
- Provide accurate information and keep it up to date.
- You're responsible for keeping your login secure and for all activity under your account, including your team members.
- Tell us promptly at support@photobooth.today if you suspect unauthorized use.
3. Subscriptions, billing, and cancellation
- Plans. We offer a free tier and paid subscription plans with different limits and features.
- Auto-renewal. Paid plans renew automatically each billing period (monthly or annual) until you cancel.
- Cancellation. You can cancel anytime from Settings → Billing. Cancellation takes effect at the end of the current paid period, and you keep access until then, after which the account returns to the Free tier.
- Price changes. We may change prices; we'll give reasonable notice before a change affects your renewal.
- Taxes. Fees are exclusive of taxes, which you're responsible for where applicable.
- Refunds. Except where required by law, fees are non-refundable, and we don't provide refunds or credits for partial periods.
4. Your data and content
You own the data and content you put into the Service (your clients, events, documents, photos, and other records) — "Your Content." You grant us a limited license to host, process, and display Your Content solely to operate the Service for you. You can export Your Content anytime from Settings → Your Data. We handle Your Content in line with our Privacy Policy.
You're responsible for Your Content and for having the rights and permissions needed to store and use it, including any personal information of your clients and staff.
5. Acceptable use
You agree not to:
- Use the Service for anything illegal, harmful, deceptive, or infringing.
- Upload malware, attempt to breach security, or access data that isn't yours.
- Reverse-engineer, resell, or misrepresent the Service.
- Overload or disrupt the Service or interfere with other customers.
6. Communications and SMS — your responsibility
The Service can send email and text messages on your behalf. When you send messages to your clients or staff, you are responsible for obtaining the necessary consent from each recipient and for complying with all applicable laws and carrier rules (including, in the U.S., the TCPA and CTIA guidelines). You must not use the Service to send spam or unsolicited messages. Every recipient must be able to opt out (reply STOP), and you must honor opt-outs. See our SMS Terms & Opt-In Policy. We may suspend messaging that appears to violate these rules.
7. Payments and third-party services
Payments are processed by third-party providers (such as PayPal and, where enabled, Stripe), and SMS is delivered by Twilio. Your use of those features is also subject to those providers' terms. We're not responsible for the acts or omissions of third-party providers.
8. Our intellectual property
The Service, including its software, design, and branding, belongs to us and our licensors. These Terms don't grant you any rights to our intellectual property except the limited right to use the Service. If you send us feedback, we may use it to improve the Service without obligation to you.
9. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted or error-free, or that it will meet every requirement. You're responsible for keeping your own backups via the export feature.
10. Limitation of liability
To the fullest extent permitted by law, PhotoBooth Today will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability arising out of or relating to the Service will not exceed the amount you paid us in the 12 months before the event giving rise to the claim.
11. Indemnification
You agree to indemnify and hold us harmless from claims, damages, and expenses arising out of Your Content, your use of the Service, your messaging to your recipients, or your violation of these Terms or applicable law.
12. Termination
You can stop using the Service and cancel at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service in a way that risks harm to others or to us. On termination, your right to use the Service ends; you can export Your Content beforehand, and we'll handle remaining data per our Privacy Policy.
13. Changes to these Terms
We may update these Terms. If changes are material, we'll update the date above and notify you in the app or by email. Continuing to use the Service after a change means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of the United States and of the state in which PhotoBooth Today is established, without regard to its conflict-of-laws rules. Any dispute will be resolved in the courts located there, unless applicable law provides otherwise.
